Is a Military Divorce Different Than a Regular Divorce?
In general, North Carolina divorce laws apply to military members the same as civilians, but with additional specifications as outlined in federal law. Understanding these differences ensures a smoother process for all parties involved.
North Carolina Military Divorce Laws
Based on the Soldiers and Sailors Civil Relief Act, 50 UCS section 521, and North Carolina law, a military divorce in the state has the following restrictions:
- Divorce proceedings can be postponed as long as the service member is deployed and up to sixty days afterward
- The active duty spouse must be served with a summons (or a waiver affidavit in an uncontested divorce) and a copy of the divorce action
- One spouse must reside or be stationed in North Carolina for at least six months
- A spouse is only eligible to receive a portion of the military member’s retirement benefits if they were married for over 10 years during active duty
- Child support and alimony payments cannot exceed 60% of the military member’s total pay and allowances
